AN ACT SETTING THE TERM OF OFFICE OF THE BARANGAY OFFICIALS AND MEMBERS OF THE SANGGUNIANG KABATAAN, AND FOR OTHER PURPOSES

Be it enacted by the Senate and House of Representatives of the Philippines in Congress assembled:

Section 1. Term of Office. - The term of office of all elected barangay and Sangguniang Kabataan officials shall be four (4) years. No elective barangay official shall serve for more than three (3) consecutive terms in the same position. No elective Sangguniang Kabataan official shall serve for more than one (1) term in the same positions. Voluntary renunciation of office for any length of time shall not be considered as an interruption in the continuity of service for the full term for which the elective official was elected.

Section 2. Date of Election. - The next regular barangay and Sangguniang Kabataan elections shall be held on the first Monday of November 2026 and every four (4) years thereafter.

Section 3. Assumption of Office. -The term of office of barangay official and members of the Sangguniang Kabataan elected after the effectivity of this Act shall commence on the first day of December next following their election.

Section 4. Hold-Over. - All incumbent barangay officials and members of the Sangguniang Kabataan shall remain in the office unless sooner removed or suspended for cause until their successors shall have been elected and qualified.

Section 5. Transitory Provision. - Incumbent elective banragany officials serving their third consecutive term in the same position shall not be eligible to run for the same position in the November 2026 Barangay and Sangguniang Kabataan Elections.

Section 6. Implementing Rules and Regulations. - Within ninety (90) days from the effectivity of this Act, the Commission on Elections shall promulgate the necessary rules and regulations for the implementation of this Act.

Section 7. Separability Clause. - If any portion or provision of this Act is declared unconstitutional, the remainder of this Act or any provision not affected thereby shall remain in force and effect.ℒαwρhi৷

Section 8. Repealing Clause. - All laws, presidential decrees, executive orders, administrative orders, and rules and regulations inconsistent with this Act are hereby repealed, amended, or modified accordingly.

Section 9. Effectivity. - This Act shall take effect fifteen (15) days after its publication in the Official Gazette or in a newspaper of general circulation.

This Act, which is a consolidation of Senate Bill No. 2816 and House Bill No.11287, was passed by the Senate of the Philippines and the House of Representatives on June 11, 2025.
