REPUBLIC ACT No. 11275

An Act Creating a Barangay to Be Known as Barangay Timbabauan in the Municipality of Tungawan, Province of Zamboanga Sibugay

Be it enacted by the Senate and House of Representatives of the Philippine Congress Assembled:

Section 1. Creation of Barangay Timbabauan. - There is hereby created a barangay to be known as Barangay Timbabauan in the Municipality of Tungawan, Province of Zamboanga Sibugay.

Section 2. Territorial Boundaries. - The territorial boundaries of Barangay Timbabauan shall be identified as follows:

Bounded on the North, along line 3-4 by Barangay Gaycon; along line 4-5 by Barangay of Masao;

On the East, along lines 5-6-7 by Barangay Libertad;

On the Southeast, along lines 7-1 by Barangay Tigbanuang;

On the Southwest, along line 1-2 by Barangay of Upper Tungawan;

On the West, along line 2-3 by Barangay of Sisay, all of Tungawan Municipality, Tungawan cadastre. PB-09-000019.

Beginning at a point marked "1" on plan, being S. 47° 40′ W., 5,467.792 meters from BLLM No. 1, Tungawan cadastre;

Section 3. Conduct and Supervision of Plebiscite. - The plebiscite conducted and supervised by the Commission on Elections (COMELEC) pursuant to Provincial Ordinance No. 11, series of 1991, dated October 8, 1991 of the Sangguniang Panlalawigan of the Province of Zamboanga del Sur, which ratified the creation of Barangay Timbabauan as proclaimed by the Plebiscite Board of Canvassers on December 2, 1994 shall serve as substantial compliance with the plebiscite requirement under Section 10 of Republic Act No. 7160, as amended, otherwise known as the "Local Government Code of 1991".

Section 4. Incumbent Barangay Officials. - The incumbent barangay officials of Barangay Timbabauan shall continue to hold office until such time that their successors have been duly elected and qualified.

Section 5. Public Infrastructure and Facilities. - All existing public infrastructure and facilities for public use therein at the time of the approval of this Act are hereby transferred without cost or compensation to and shall be administered by the new barangay.1âwphi1

Section 6. Internal Revenue Allotment Shares. - Barangay Timbabauan shall be entitled to Internal Revenue Allotment shares pursuant to Section 285 of Republic Act No. 7160, as amended, otherwise known as the "Local Government Code of 1991".

Section 7. Effectivity. - This Act shall take effect fifteen (15) days after its publication in the Official Gazette or in a newspaper of general circulation.
