REPUBLIC ACT No. 11221

An Act Establishing the City Prosecution Service in the City of Navotas, Amending for the Purpose Section 55 of Republic Act No. 9387, Otherwise Known as the "Charter of the City of Navotas"

Be it enacted by the Senate and House of Representatives of the Philippine Congress Assembled:

Section 1. Section 55 of Republic Act No. 9387, otherwise known as the "Charter of the City of Navotas", is hereby amended to read as follows:

"Section 55. Ihe Office of the City Prosecution Service and Public Schools Division.—

"(a) There shall be established in the City, a prosecution service to be headed by a city prosecutor and such number of assistant city prosecutors as may be necessary, who shall form part of the Department of Justice (DOJ) and be under the supervision and control of the Secretary of Justice, and whose qualifications, manner of appointment and rank, salary and benefits shall be governed by existing laws covering prosecutors in the DOJ.

"(b) The city prosecutor shall handle the prosecution of cases and perform such other functions as provided by law and its implementing rules and regulations. The existing City Prosecution Service in the City of Malabon shall continue to function pursuant to existing laws under the supervision of the city prosecutor.

"The Secretary of Justice shall always ensure the adequacy and the quality of prosecution service in the City of Navotas and, for this purpose, shall, in the absence, lack or insufficiency in the number of assistant city prosecutors as provided hereinabove, designate from among the assistant provincial prosecutors a sufficient number to perform and discharge the functions of the City Prosecution Service.

"Likewise, the public schools division for the cities of Malabon and Navotas shall continue to administer public education in both local government units."

Section 2. The Department of Justice and the Department of Budget and Management are hereby directed to implement this Act.1âwphi1

Section 3. All laws, decrees, executive orders, rules and regulations which are inconsistent with this Act are hereby amended, repealed or modified accordingly.

Section 4. This Act shall take effect fifteen (15) days after its publication in the Official Gazette or in a newspaper of general circulation.
