[ REPUBLIC ACT NO. 5902, June 21, 1969 ]

AN ACT AMENDING FURTHER REPUBLIC ACT NUMBERED FOUR THOUSAND NINETY-FOUR, AS AMENDED, AND FOR OTHER PURPOSES.

Be it enacted by the Senate and House of Representatives of the Philippines in Congress assembled:

Section 1. Section one of Republic Act Numbered Four thousand ninety-four is hereby further amended to read as follows:

"Section 1. In the performance of his duties, the Secretary of Justice shall be assisted by a Technical Staff which shall have one Chief to be known as the Head Technical Assistant with a salary of seventeen thousand pesos per annum, and two assistant chiefs to be known as Senior Technical Assistants each of whom shall receive an annual salary of sixteen thousand three hundred twenty pesos per annum, two Senior Special Assistants each of whom shall receive a salary of fifteen thousand seven hundred twenty pesos per annum and eight special assistants whose salaries shall be as follows:1âшphi1

"(a) Two Special Assistants each at fifteen thousand pesos per annum;

"(b) Two Special Assistants each at fourteen thousand four hundred pesos per annum;

"(c) Two Special Assistants each at thirteen thousand eight hundred pesos per annum; and

"(d) Two Special Assistants each at thirteen thousand two hundred pesos per annum.

"The present incumbents of the above positions shall receive their salary adjustments without the need of re-appointment."

Section 2. Section Two of the same Act is hereby amended to read as follows:

"Section 2. The Head Technical Assistant shall have the same qualifications as the first assistant solicitor general. The two senior technical assistants, the Senior Special Assistants and the Special Assistants shall have the same qualifications as a provincial fiscal or must have held the position of Senior Executive Assistant or Chief Training Officer in the Office of the Secretary of Justice for a period of at least five years: Provided, That no officer on employee holding office as such in the Office of the

Secretary of Justice on the date of the passage and effectivity of this Act shall, by reason thereof, be removed from office or be demoted to a lower category or scale except for cause as provided by law and after due process."

Section 3. In addition to appropriations provided in the General Appropriations Act for the Office of the Secretary of Justice, such amounts as may be necessary to carry out the provisions of this Act are hereby authorized to be appropriated out of any funds of the National Treasury not otherwise appropriated. Thereafter, such sums shall be included in the annual General Appropriations Act.

Section 4. This Act shall take effect upon its approval.
