[ REPUBLIC ACT NO. 5882, June 21, 1969 ]

AN ACT AMENDING THE TITLE AND SECTIONS ONE AND FOUR OF REPUBLIC ACT NUMBERED FOUR THOUSAND SIX HUNDRED AND FIVE, AS AMENDED.

Be It Enacted by the Senate and House of Representatives of the Philippines in Congress assembled:

Section 1. The Title Of Republic Act Numbered Four thousand six hundred and five is amended to read as follows:

"An Act Granting Aqce Incorporated a franchise to construct, operate and maintain an ice plant in the City of San Pablo, Province of Laguna, and to sell ice and to operate, maintain and supply cold storages in any of the municipalities and cities within the Provinces of Laguna, Batangas and Quezon."

Section 2. Section one of the same Act is hereby amended to read as follows:

"Section 1. Subject to the conditions imposed by this Act, there is hereby granted to AQCE incorporated, hereinafter referred to as the grantee, a franchise to construct, operate and maintain an ice plant in the City of San Pablo, Province of Laguna, and to sell ice, and to operate, maintain and supply cold storages in any of the municipalities and cities within the entire Provinces of Laguna, Batangas and Quezon and to charge and collect a schedule of prices and rates for the ice and cold storages so furnished, which  schedule of prices and rates shall at all times be subject  regulation by The Public Service Commission."

Section 3. Section four of the same Act is hereby amended to read as follows:

"Section 4. The franchise shall continue for a period of twenty-five years from the date said plant in the City Of San Pablo is placed in operation and/or commences the sale and distribution of ice in the municipalities and cities in the entire Provinces of Laguna, Batangas and Quezon, subject to the express condition that the franchise shall be null and void unless the construction of said plant be begun within five years from the date of the approval of this act and completed within six years from said date, except when prevented by an act of god, or force majeure, martial law, riot, civil commotion, usurpation by military power or any cause beyond the grantee's control."

Section 4. Whenever the term "grantee" is used in republic Act Numbered Four thousand six hundred and five, as1 amended, as well as in this amendatory act, it shall be held and understood to mean and represent the AQCE Incorporated, Its Successors or Assigns.

Section 5. This Act shall take effect upon its approval.1a⍵⍴h!1
