REPUBLIC ACT No. 1288

An Act to Regulate the Planting, Gathering or Selling of "Tubli" and Other Poisonous Plants and to Penalize Any Violation Thereof

Be it enacted by the Senate and House of Representatives of the Philippine Congress Assembled:

Section 1. No person shall plant, gather or sell "tubli" or other poisonous plants or the fruits thereof without a permit duly issued by the Director of the Bureau of Plant Industry, or his duly authorized representative.

A nominal fee may be charged for the issuance of such permit.

Section 2. The Director of Plant Industry shall promulgate such rules and regulations as he may deem proper and necessary to regulate the planting, gathering or selling of "tubli" and other poisonous plants or the fruits thereof.

Section 3. Any person who sells "tubli" or other poisonous plants or the fruits thereof shall immediately submit a report of such sale to the Chief of Police stating the name of the purchaser, quantity sold, the purchase price, and the lawful use intended for the same, who shall in turn forward the same to the Director of Plant Industry.

Section 4. Any violation of the provisions of this Act shall be punished by a fine of not more than one hundred pesos or by imprisonment for not more than fifteen days, or by both such fine and imprisonment, in the discretion of the court.

Section 5. This Act shall take effect upon its approval.
