EXCLUDING FROM THE COVERAGE OF PROCLAMATION NO. 100, SERIES OF 1936, WHICH ESTABLISHED THE CAMP MELCHOR DELA CRUZ MILITARY RESERVATION LOCATED IN BARANGAY UPI, MUNICIPALITY OF GAMU, PROVINCE OF ISABELA, ISLAND OF LUZON, A CERTAIN PORTION OF THE LAND EMBRACED THEREIN AND DECLARING THE SAME OPEN FOR DISPOSITION FOR AFP OFF BASE HOUSING PURPOSES
Upon recommendation of the Secretary of Environment and Natural Resources and by virtue of the powers vested in me by law, I, GLORIA MACAPAGAL ARROYO, President of the Republic of the Philippines, do hereby exclude from the operation of Proclamation No. 100, Series of 1936, which established the Camp Melchor dela Cruz Military Reservation located in Barangay Upi, Municipality of Gamu, Province of Isabela, Island of Luzon, a certain portion of the land embraced therein and declaring the same for AFP Off Base housing purposes, subject to private rights, if any there be and to final survey, which portion is more particularly described as follows:

A PARCEL OF LAND (Lot 2-A, SWO (af) 02-000031), situated in Barangay Upi, Municipality of Gamu, Province of Isabela, Island of Luzon. Bounded on the North, along lines 1-2-3-4-5-6 by Public Land; on the SE., along line 6-7-8 by Public Land; and on the SW., along lines 8-9-10-11-12-13-1 by Lot 2-B, SWO (af) 02-000031. Beginning at a point marked “1” on the plan being S. 15° 11' W., 7184.19 m. from BLLM No. 1, Ilagan Cadastre Thence:

The area herein reserved shall be divided into two equal parts for disposition as follows:
1. The first part shall be open for alienation and disposition in accordance with the provisions of Republic Act No. 274 in relation to the provisions of Commonwealth Act 141 known as the Public Land Act; and
2. The second part shall be disposed through usufruct for a period of twenty- five (25) years renewable for another twenty-five (25) years. The management and administration of which shall be under the Department of National Defense-Armed Forces of the Philippines (DND-AFP) pursuant to pertinent provisions of the Civil Code of the Philippines and other existing applicable laws, rules and regulations.
Such part or parts of the area herein declared as AFP Off Base Housing Site, which are being used or earmarked for public or quasi-public purposes shall be excluded from such disposition. Except in favor of the Government or any of its branches or agencies, all lands disposed of pursuant to this proclamation shall not be subject to alienation and encumbrance for a period of ten (10) years from the issuance of the title, in case of sale or execution of contract in case of usufruct, nor shall they become liable to the satisfaction of any debt contracted prior to the expiration of the said period; but the improvements on the land may be mortgaged to qualified persons, associations, partnerships or corporations.
A Committee composed of representatives from the DND-AFP is hereby created to ensure efficient management and administration of the program.
