AMENDING PROCLAMATION NO. 96 DATED SEPTEMBER 3, 2001, WHICH RESERVED CERTAIN PARCEL OF LAND OF THE PUBLIC DOMAIN LOCATED IN TONDO, MANILA, FOR SOCIALIZED HOUSING SITE PURPOSES OPEN FOR DISPOSITION IN FAVOR OF THE ACTUAL OCCUPANTS BY CHANGING THE MODE OF DISPOSITION FROM R.A. NO. 730 TO R.A. NO. 7279 OTHERWISE KNOWN AS “THE URBAN DEVELOPMENT AND HOUSING ACT”, AND AUTHORIZING THE ISSUANCE OF SPECIAL PATENT IN FAVOR OF THE NATIONAL HOUSING AUTHORITY OVER THE AREA OCCUPIED BY INFORMAL SETTLERS

Upon recommendation of the Secretary of Environment and Natural Resources, and pursuant to the powers vested in me by law, I, GLORIA MACAPAGAL-ARROYO, President of the Republic of the Philippines, do hereby amend Proclamation No. 96 dated September 3, 2001, which reserved a certain parcel of land of the public domain located in Binondo, Manila, for socialized housing purposes open for disposition in favor of the qualified beneficiaries pursuant to the provision of Republic Act (RA) No. 730, in relation to the Public Land Act, by changing the mode of disposition from R.A. No. 730 to R.A. No. 7279, otherwise known as the Urban Development and Housing Act of 1992, and authorizing the issuance of Special Patent over the area occupied by informal settlers, subject to private rights, if there be any, and to actual survey, which area is more particularly described as follows:

LOT 1, RI-00-000019

A PARCEL OF LAND (Lot 1, as shown in the reclaimed land survey plan RI-00-000019), situated in the District of Tondo, City of Manila, Island of Luzon.

Bounded on the NW, along lines 1-2-3 by Slip-O Access Road; on the E, SE and NE, along lines 3-4-5-6 by Philippine Ports Authority; and on the SW, along lines 6-7-8-9-10-11-12-13-14-1 by Lot 6 (Railroad) of the subdivision plan.

Bounded on the SW., along line 1-2 by RI-04-000002 Republic of the Philippines (Government Service Insurance System) contested by Phil. Port Authority; bounded on the North and East, along lines 2-3-4 by Lot 4 of the reclaimed land survey plan; and on the SE., along lines 4-5-1 by MICT South Access Road.

Beginning at a point marked “1” on plan, being N. 83 deg. 56' W., 1115.13 m. from BLLM No. 27, Manila Cadastre, to corner 1; thence

N. 34 deg. 47' W., 46.58 m. to point 2;
N. 88 deg. 56' E., 106.43 m. to point 3;
S. 04 deg. 17' W., 4.01 m. to point 4;

containing an area of TWO THOUSAND TWO HUNDRED TWENTY EIGHT (2,228) SQUARE METERS more or less. All points referred to and are marked on the ground by: corner of existing conc. fence; bearings true; date of original survey, that of the reclaimed land survey, March 19-22, 25-26 and April 2 and 10, 2002; and approved on June 6, 2003.

The Secretary of Environment and Natural Resources is hereby authorized to issue a Special Patent covering the area herein reserved for socialized housing purposes in favor of the National Housing Authority (NHA).1aшphi1

The NHA shall reimburse the national government the value of the land after the final payment of the areas reserved for socialized housing purposes by the qualified beneficiaries.

The portions of the area herein reserved for socialized housing purposes open for disposition that are being used or earmarked for public or quasi-public purposes shall be excluded from such disposition.

An Inter-Agency Committee (LIAC) shall be created pursuant to Presidential Memorandum Order No. 74, s. 2002 and other related issuances in the performance of its functions.
