PROCLAIMING A PARCEL OF LAND COMMONLY KNOWN AS ISLA VERDE, AND SITUATED AT BARANGAY 23-C, POBLACION, DAVAO CITY, AS A HUMAN SETTLEMENT SITE; GRANTING OWNERSHIP THEREOF TO THE CITY OF DAVAO; AND DECLARING THE SAME OPEN FOR DISPOSITION IN ACCORDANCE WITH THE CITYS COMPREHENSIVE DEVELOPMENT PLAN

Upon the recommendation of the Secretary of Environment and Natural Resources, Mayor Benjamin de Guzman and Congressman Rodrigo R. Duterte, and by virtue of the powers vested in me by law, I, JOSEPH EJERCITO ESTRADA, President of the Philippines, do hereby proclaim a tract of land of the public domain, commonly known as Isla Verde and situated at Barangay 23-C, Poblacion, Davao City, as a Human Settlement Site; grant ownership thereof to the City of Davao; and declare the same open for disposition in favor of qualified beneficiaries in accordance with the Citys Comprehensive Development Plan and with the provisions of Republic Act No. 7160, otherwise known as the Local Government Code of 1991, and Republic Act No. 7279, otherwise known as the Urban Development and Housing Act of 1992, subject to private rights, if any there be, which parcel of land is identified on Plan Swo-11-000616, situated at Barangay 23-C, Poblacion, City of Davao, Island of Mindanao, and more particularly described as follows:

“A parcel of land (Lot 1, Swo-11-000616), situated at Barangay 23-C, Poblacion, Davao City, Island of Mindanao, bounded along lines 1-2-3; 21-22-1 by Mr-11-0000004; along lines 3-4-5-6-7 by Magsaysay Park; and along lines 7-8 by Mr-112402-000024; along lines 8-9-10-11-12-13-14-15-16-17-18-19-20-21 by Lot 2, Swo-11-000616 (Permanent Forest). Beginning at a point marked “1” on plan being N. 56 deg. 09E., 5638.24 meters from B.L.L.M. No. 22, Cad-102, Davao Cadastre;

All points referred to are indicated on the plan and marked on the ground as follows: corners 1, 2, 7, 8 and 22 by old “P.S.”, cyl. conc. mons. 15 x 60 cm., and the rest are G.S., cyl. conc. mons. 15 x 40 cm.

NOTE: The survey of this lot was conducted pursuant to the Joint Special Order No. 1-98 dated September issued by Regional Executive Director Augustus L. Momongan, DENR, Region XI, and the City Mayor by Davao City Administrator, Atty. Nestor M. Ledesma, on September 24-25, 1998 by Geodetic Engineer III Gerardo R. Dida; and was approved by Regional Technical Director Agapito S. Borinaga, Lands Management Services, DENR Region XI, Davao City, on September 29, 1998.

Such part of parts of the area herein declared open for disposition, which are being used or earmarked for public or quasi-public purposes, shall be excluded from such disposition. Except in favor of the government or any of its branches, units, institutions or agencies, lands disposed of under this proclamation shall not be the subject to alienation and encumbrance for a term of ten (10) years from the issuance of the deed of sale/conveyance, in case of sale, or execution of contract, in case of lease, nor shall they become liable to the satisfaction of any debt contracted prior to the expiration of said period, except for housing loan purposes, but the improvements on the land may be mortgaged to qualified persons, associations, or corporations.

The Department of Environment and Natural Resources shall cause the issuance of a special patent in favor of the City of Davao covering the parcel of land aforementioned.
