[ Proclamation No. 224, December 28, 1999 ]

DECLARING THE OWNERSHIP OF A CERTAIN PARCEL OF LAND SITUATED IN ERMITA, MANILA, FORMERLY OWNED BY THE PHILIPPINE JAI-ALAI CORPORATION, AS VESTED IN THE REPUBLIC OF THE PHILIPPINES BY OPERATION OF LAW

WHEREAS, pursuant to the provisions of Commonwealth Act. No. 485, as amended, the land and improvements on which the court and stadium for Basque pelota are established shall, twenty-five years after the first game of Basque pelota was played with bets, become the property of the Government of the Philippines;

WHEREAS, pursuant to Section 1 of Presidential Decree No. 809, ownership of that certain parcel of land with an area of 6,470.30 square meters, more or less, situated in Ermita, Manila and covered by TCT No. 75739 of the Registry of Deeds of Manila wherein the court and stadium for Basque pelota operated by the Philippine Jai-Alai and Amusement Corporation (PJAC), was transferred and vested in the National Development Company (NDC);

WHEREAS, the NDC subsequently sold the said parcel of land to PJAC, subject to the condition prescribed in Section 4 of Presidential Decree No. 809 that after the expiration of the franchise of PJAC, the land and all improvements including facilities thereon shall revert to the Government of the Philippines without payment.

WHEREAS, pursuant to Executive Order No. 169 dated May 8, 1987, the franchise of PJAC granted under Presidential Decree No. 810, as amended, was revoked and cancelled; and

WHEREAS, while by operation of law, the national government is now the owner of the aforesaid property, the corresponding certificate of title still remains with the name of PJAC for want of proper documentation.1aшphi1

NOW, THEREFORE, I, JOSEPH EJERCITO ESTRADA, President of the Philippines, by virtue of the power vested in me by law, do hereby declare the ownership of that parcel of land which used to be owned by the Philippine Jai-Alai and Amusement Corporation situated in Ermita, Manila and covered by TCT No. 120506 of the Registry of Deeds of the City of Manila, more particularly described as follows:

“A parcel of land (lot 1-B-2, of the subdivision plan (LRC) Psd-36349, being a portion of Lot 1-B described on plan (LRC) Psd-11613, LRC Cad. Rec. No. 392), situated in the District of Ermita, City of Manila, Island of Luzon. Bounded x x x to the point of beginning; containing an area of SIX THOUSAND FOUR HUNDRED AND SEVENTY SQUARE METERS AND THIRTY SQUARE DECIMETERS (6470.30) more or less. x x x”

as vested in the Republic of the Philippines. Accordingly, the Register of Deeds of the City of Manila is directed to cancel TCT No. 122150 in the name of the Philippine Jai-Alai Corporation and issue, in lieu thereof, a new title in the name of the Republic of the Philippines, represented by the Office of the President.

IN WITNESS WHEREOF, I have hereunto set my hand and caused the seal of the Republic of the Philippines to be affixed.
