AMENDING PROCLAMATION NO. 684 DATED 20 APRIL 1970, WHICH RESERVED CERTAIN PARCELS OF LAND SITUATED AT FORT BONIFACIO, TAGUIG, METRO MANILA, FOR UNIVERSITY CENTER PURPOSES UNDER THE DEPARTMENT OF EDUCATION, (NOW DEPARTMENT OF EDUCATION, CULTURE AND SPORTS), BY EXCLUDING PORTIONS OF THE LAND EMBRACED THEREIN AND DECLARING THE SAME OPEN FOR DISPOSITION TO QUALIFIED OCCUPANTS IN ACCORDANCE WITH REPUBLIC ACT NO. 730, IN RELATION TO THE PROVISIONS OF THE PUBLIC LAND ACT (C. A. 141, AS AMENDED)

Upon recommendation of the Secretary of Environment and Natural Resources, and by virtue of the powers vested in me by law, I, JOSEPH EJERCITO ESTRADA, President of the Philippines, do hereby amend Proclamation No. 684 dated 30 April 1970, which reserved certain parcels of land situated in Fort Bonifacio, Taguig, Metro Manila for University Center purposes under the Department of Education (now DECS), by excluding portions of the land embraced therein and declaring the same open for disposition to qualified occupants in accordance with Republic Act (R.A.) No. 730, in relation to the provisions of Public Land Act (C.A. 141, as amended), subject to private rights, if any there be, which parcels are more particularly described as follows:

LOT No. 10901-A, Psd-00-045790

A PARCEL OF LAND (Lot 10901-A of the subdivision plan Psd-00-045790, being a portion of Lot 10901, Mcadm-590-D, Taguig Cadastral Mapping, (Lot 10120-B, Swo-00-001262) situated in barangay Fort Bonifacio, municipality of Taguig, Metro Manila, Island of Luzon. Bounded on the NW., along line 1-2-3-4 by Lot 64-A-2-A-I-A-I-A, Psd-21002; on the NE., and SE., along lines 4-14 by Lot 10901-B of the subdivision plan; and on the SW., along line 14-1 by Manila Railroad Company, Psu-4730 (30.00 m. wide). point of beginning, containing an area of SIXTY SEVEN THOUSAND TWO HUNDRED SEVENTY (67,270) SQUARE METERS, more or less. All points referred to are indicated on the plan and are marked on the ground by PS. Cyl. Conc. mons. 15 x 60 cm., except points 17 to 26 by Old PS. Cyl. conc. Mons. 15 x 60 cm. Bearings grid. Date of Original Survey on November-December 1909 (Psu-2031) and that of the subdivision survey on July 15, 1997 executed by Geodetic Engineer Mariano V. Flotildes and was approved on October 20, 1997.

Such part or parts of the area herein declared open to disposition under R.A. No. 730, in relation to the provisions of the Public Land Act, which are being used or earmarked for public quasi-public purpose shall be excluded from such disposition. Existing roads or proposed roads within the area shall conform with the provisions of Executive Order No. 113, series of 1995. With respect to the residential lots which may be established within the proclaimed areas, the area of each residential lot shall be that which is actually occupied but in no case shall exceed Three Hundred (300) square meters, but subject to reduction due to extremely meritorious grounds to be determined by the authorized DENR Official concerned.

With respect to commercial lots which may be established within the proclaimed areas, the area of each commercial lot shall not exceed Three Hundred (300) square meters, subject to reduction due to extremely meritorious ground to be determined by the DENR Secretary upon recommendation of the Regional Executive Director, DENR National Capital Region. All commercial lots shall be disposed of by public auction to qualified applicants pursuant, to the provisions of Chapter IX of the Public Land Act (C.A. 141, as amended).

Except in favor of the government or any of its branches or agencies, all lands disposed of for residential purposes under this proclamation shall not be subject to encumbrance and alienation before the issuance of title and for a term of ten (10) years thereafter nor shall they become liable to the satisfaction of any debt contracted prior to the expiration of said period, but the improvements on the land may be mortgaged to qualified persons, associations or corporations.

No alienation, transfer or conveyance of any residential land covered by this proclamation shall be made before the issuance of title and within ten (10) years thereafter, provided that such alienation, transfer or conveyance may be made after ten (10) years, but before twenty-five (25) years after the issuance of title, upon approval of the Secretary of Environment and Natural Resources, which approval shall not be denied except on constitutional and legal grounds.

The DENR-National Capital Region shall conduct or supervise the actual subdivision survey of the proclaimed areas. In the execution of the subdivision survey of the proclaimed areas, spaces/open spaces for parks, playgrounds, barangay hall, school site and sufficient roads and alleys for the convenience of the residents thereat, shall be strictly provided.
