MALACAÑAN PALACE MANILA BY THE PRESIDENT OF THE PHILIPPINES [ Proclamation No. 674, May 12, 1960 ] EXCLUDING FROM THE OPERATION OF EXECUTIVE ORDERS NOS. 35 AND 35, SERIES OF 1904 AND 1912, RESPECTIVELY, A PARCEL OF LAND IN THE SITIO OF BINABAAN, MUNICIPALITY OF CULION, PROVINCE OF PALAWAN, ISLAND OF CULION, AND DECLARING THE SAME OPEN TO DISPOSITION UNDER THE PROVISIONS OF COMMONWEALTH ACT NO. 137, AS AMENDED WHEREAS, a petition has been filed for the exclusion of a certain parcel of land from the operation of Executive Orders Nos. 35 and 35, series of 1904 and 1912, respectively, which established the Culion Leper Colony reservation; WHEREAS, the findings of the Director of Mines show that the area sought to be excluded from the Culion Leper Colony reservation is not at present inhabited by lepers and is highly mineralized; NOW, THEREFORE, upon the recommendation of the Secretary of Agriculture and Natural Resources and pursuant to the provisions of section 14 of Commonwealth Act No. 137, otherwise known as the Mining Act, I, Carlos P. Garcia, President of the Philippines, do hereby exclude certain parcel of the public domain from the Culion Leper Colony reservation established under Executive Orders Nos. 35 and 35, series of 1904 and 1912, respectively, and declare the same open to disposition under the provisions of the Mining Act, which area is particularly described to wit: Beginning at a point marked 1, which is the Coast and Geodetic Station OLTALORO on the summit of Mount Oltaloro, province of Palawan, with latitude 11° 43' 49.706" and longitude 120° 01' 42.340"; thence S. 37° 12' E., 1,510.00 meters to point 2; thence S. 66° 45' W., 188.81 meters to point 3; thence S. 50° 44' W., 1,044.88 meters to point 4; thence S. 38° 26' W., 642.98 meters to point 5; thence N. 78° 20' W., 1,375.00 meters to point 6; and thence N. 40° 00’E., 2,825.13 meters to point 1; which is the point of beginning, containing an area of 297.9013 hectares, more or less; subject to the condition that if within three years from the date of the granting of the lease by the government the applicant does not start the exploitation of the mineral resources of the above-described parcel of land, or upon the termination of the exploitation of the said parcel of land, or in the event the applicant abandons the work, the said parcel of land shall revert as part of the Culion Leper Colony reservation.
