[ EXECUTIVE ORDER NO. 45, October 25, 2023 ]

TRANSFERRING THE ATTACHMENT OF THE DEVELOPMENT ACADEMY OF THE PHILIPPINES TO THE NATIONAL ECONOMIC AND DEVELOPMENT AUTHORITY

WHEREAS, Presidential Decree No. 205 (s. 1973), as amended, created the Development Academy of the Philippines (DAP) to promote and support the country's development efforts by carrying out human resource programs that are designed to instill development perspectives and advance management capability in the key sectors of the government and the economy;

WHEREAS, DAP is presently attached to the Office of the President (OP) in view of Section 23, Chapter 8, Title II, Book III of Executive Order (EO) No. 292 or the “Administrative Code of 1987;”

WHEREAS, under EO No. 230 (s. 1987), the National Economic and Development Authority (NEDA) is the primary agency responsible to formulate continuing coordinated, and fully-integrated social and economic policies, plans and programs;

WHEREAS, strengthening the analytical, operational and evaluation capacity of civil servants, and raising the productivity performance of agencies are among the strategies identified in the Philippine Development Plan 2023-2028 to improve bureaucratic efficiency;

WHEREAS, a strong organizational link between the NEDA and DAP is necessary to bolster the development and implementation of the latter's human resource development programs, research, data collection, and information services, as well as to ensure consistency of its research, education and training with the National Government's socioeconomic agenda;

WHEREAS, pursuant to the rightsizing policy of the National Government, it is imperative to streamline and rationalize the functional relationships of agencies with organizational mandates in order to promote coordination, efficiency, and organizational coherence in the bureaucracy;

WHEREAS, under Section 31, Chapter 10, Title III, Book III of EO No. 292, the President in order to achieve simplicity, economy and efficiency, shall have continuing authority to reorganize the administrative structure of the OP, and for this purpose, may transfer any agency under the OP to any other department or agency; and

WHEREAS, Section 17, Article VI of the Constitution vests in the President the power of control over all Executive departments, bureaus and offices, and the mandate to ensure the faithful execution of laws;

NOW, THEREFORE, I, FERDINAND R. MARCOS, JR., President of the Philippines, by virtue of the powers vested in me by the Constitution and existing laws, do hereby order:

Section 1. Attachment. The DAP is hereby attached to the NEDA for policy and program coordination.

Section 2. Separability. If any part or provision of this Order shall be held invalid, or unconstitutional, the provisions not affected thereby shall remain in full force and effect.1aшphi1

Section 3. Repeal. All orders, rules and regulations, and other issuances or parts thereof which are inconsistent with the provisions of this Order are hereby repealed or modified accordingly.

Section 4. Effectivity. This Order shall take effect immediately upon publication in the Official Gazette or in a newspaper of general circulation.
