[ EXECUTIVE ORDER NO. 37, August 10, 2023 ]

APPROVING AND ADOPTING THE NATIONAL SECURITY POLICY 2023-2028

WHEREAS, the prime duty of the government is to serve and protect the people;

WHEREAS, Section 7, Article II of the Constitution declares it a policy of the State to pursue an independent foreign policy, the paramount consideration of which shall be national sovereignty, territorial integrity, national interest, and the right to self-determination;

WHEREAS, consistent with the President's vision of free, united, secure, peaceful, resilient, and prosperous archipelagic nation, the National Security Policy (NSP) 2023-2028 was formulated in coordination and consultation with key government agencies and instrumentalities, and with the participation of various stakeholders, to provide guidance and a comprehensive approach to improving security sector governance in order to effectively address national security challenges;

WHEREAS, to ensure the successful implementation of the NSP 2023-2028, there is a need to align all national security-related strategies, as well as the plans and programs of all national government agencies (NGAs) and instrumentalities, including government-owned or -controlled corporations (GOCCs), and local government units (LGUs), with the NSP 2023-2028;

WHEREAS, there is a need to harmonize the national security efforts of the Government and ensure that they are responsive and complementary to the development goals and objectives set forth in the Philippine Development Plan 2023-2028; and

WHEREAS, Section17, Article VII of the 1987 Constitution provides that the President shall have control over all Executive departments, bureaus or offices, and ensure the faithful execution of laws:

NOW, THEREFORE, I, FERDINAND R. MARCOS, JR., President of the Philippines, by virtue of the powers vested in me by the Constitution and existing laws, do hereby order:

Section 1. Approval of the NSP 2023-2028. The NSP 2023-2028 is hereby approved.

Section 2. Adoption and Implementation of the NSP 2023-2028. All NGAs and instrumentalities, including GOCCs, and LGUs shall adopt the NSP 2023-2028 in the formulation and implementation of their security-related strategies and programs.

Section 3. Support from All  Sectors. All NGAs and instrumentalities, including GOCCs, and LGUs shall encourage all sectors of society to participate in the implementation of the NSP 2023-2028 towards achieving a holistic approach to addressing national security issues and priorities, consistent with their mandates, in their respective areas of expertise or jurisdiction.

Section 4. Technical Assistance. Whenever necessary, the National Security Council (NSC) Secretariat shall provide technical assistance and support to agencies and other government entities in the formulation of policies and strategies affecting national security.

Section 5. Reporting and Monitoring. The National  Security Adviser (NSA) shall conduct a periodic assessment and submit reports to the President and the NSC on the implementation of the NSP 2023-2028, and coordinate with the various NGAs and instrumentalities, GOCCs, and LGUs in the preparation thereof.

For this purpose, the NSC, through the NSA, shall monitor the implementation of the NSP 2023-2028, and upon consultation with and concurrence of relevant government agencies, GOCCs, and LGUs, shall propose memoranda, circulars and other orders related to the implementation thereof, for the approval of the President.

Section 6. Funding. The funds necessary for the implementation of this Order shall be charged against current and available appropriations of concerned agencies, subject to pertinent budgeting, accounting, and auditing laws, rules and regulation.1aшphi1 Thereafter, the funding requirements for succeeding years shall be included in the annual General Appropriations Act, subject to the usual budget preparation process.

Section 7. Separability. If any part of provision of this Order shall be held invalid or unconstitutional, the provisions not affected thereby shall remain in full force and effect.

Section 8. Repeal. All orders, rules and regulations, and other issuances or parts thereof which are inconsistent with the provisions of this Order are hereby repealed or modified accordingly.

Section 9. Effectivity. This Order shall take effect immediately upon publication in the Official Gazette or in a newspaper of general circulation.
