[ EXECUTIVE ORDER NO. 30, June 01, 2023 ]

STRENGTHENING PRIVATE SECTOR PARTICIPATION IN THE PUBLIC-PRIVATE PARTNERSHIP GOVERNING BOARD ESTABLISHED UNDER EXECUTIVE ORDER (EO) NO. 136 (S. 2013), AND FURTHER AMENDING EO NO. 8 (S. 2010), AS AMENDED, FOR THE PURPOSE

WHEREAS, Executive Order (EO) No. 8 (s. 2010) reorganized the Build-Operate and transfer (BOT) Center, renamed it as the Public-Private Partnership (PPP) center, which is attached to the National Economic and Development Authority (NEDA), and mandated the same to serve as the central coordinating and monitoring agency for all PPP projects in the country;

WHEREAS, EO no. 136 (s. 2013) amended EO No. 8, as amended, the private Sector Co-Chairperson of the National Competitiveness Council (NCC) is among the members of the PPPGB;

WHEREAS, Republic Act (RA) No. 11032 or the "Ease of Doing Business and Efficient Government Service Delivery Act of 2018" recognized the NCC as the Ease of Doing Business and Anti-Red Tape Advisory Council, rendering the position of the Private Sector Co-Chairperson of the NCC inexistent;

WHEREAS, there is a need to further amend EO No. 8, as amended, in view of the reorganization of the NCC; and

WHEREAS, Section 17, Article VII of the Constitution provides that the President shall have control of all Executive departments, bureaus, and offices;

NOW, THEREFORE, I, FERDINAND R. MARCOS, JR., President of the Philippines, by virtue of the powers vested in me by the Constitution and existing laws, do hereby order:

Section 1. Amendment. Section 3A of EO No. 8, as amended, is hereby further amended to read as follows:

"Section 3A. PPP Governing Board. The PPP governing Board is hereby created, which shall be the overall policy-making body for all PPP-related matters, including the PDMF. It shall be responsible for setting the strategic direction of the PPP Program and creating an enabling policy and institutional environment for PPP.

The PPP Center shall report directly to the PPP Governing Board which shall be composed of the following:

Chairperson : Secretary of Socio-Economic Planning
Vice-Chairperson : Secretary of Finance
Members : Secretary of Budget and Management;

Secretary of Justice;

Secretary of Trade and Industry;

Executive Secretary; and

One (1) representative from the private sector, coming from a reputable organization in the banking, business, or infrastructure sector, to be appointed by the President.

The private sector representative shall promptly notify the PPPGB of any actual, perceived, or potential conflict of interest which could affect the performance of his/her duties as a member of the Governing Board.£A⩊phi£

The Chairperson and three (3) other members of the Board shall constitute a quorum and a majority vote of the members present shall be necessary for the adoption of any issuances, order, resolution, decision, or other act of the Board in the exercise of its functions.

The PPP Center shall act as Secretariat of the PPP Governing Board."

Section 2. Unaffected Provisions. except as expressly modified by this Order, all other provisions of EO No. 8., as amended, shall remain in full force and effect.

Section 3. Repeal. All orders, rules, regulations and issuances or parts thereof, which are inconsistent with this Order, are hereby repealed or modified accordingly.

Section 4. Effectivity. This Order shall take effect immediately.
