[ EXECUTIVE ORDER NO. 840, October 23, 2009 ]

DECLARING THE 1,551.1416-HECTARE PROPERTY OF THE DEPARTMENT OF FINANCE LOCATED IN BARANGAYS TARTARO, CALUMPANG, SIBUL, KINAMATAYANG KABAYO, STA. LUCIA AND MALIBAY, ALL IN SAN MIGUEL, BULACAN, AS A HOUSING SITE FOR GOVERNMENT EMPLOYEES AND AS A RELOCATION SITE FOR INFORMAL SETTLER FAMILIES

WHEREAS, it is the priority concern of the government to provide housing to homeless Filipinos;

WHEREAS, a certain parcel of land, with an area of about 1,551.1416 hectares located in Barangays Tartaro, Calumpang, Sibul, Kinamatayang Kabayo, Sta. Lucia and Malibay, all in San Miguel, Bulacan, was transferred from the Manila Banking Corporation (MBC) to the Bangko Sentral ng Pilipinas (BSP) on 18 June 1999;

WHEREAS, in a Memorandum of Agreement dated 27 April 2006, entered into among the Department of Finance (DOF), BSP, National Housing Authority (NHA) and MBC, the said property was conveyed to the National Government by way of property dividends for government housing projects;

WHEREAS, pursuant to Executive Order No. 131, s. 2002, the Housing and Urban Development Coordinating Council (HUDCC), in coordination with DOF and the BSP, identified the said property as a suitable housing site for government employees; and

WHEREAS, in order to alleviate the sufferings of informal settler-families whose homes in danger areas were devastated by Typhoon Ondoy, portions of the subject property are allocated as relocation site for them and other similarly situated victims of future catastrophes.

NOW, THEREFORE, I, GLORIA MACAPAGAL-ARROYO, President of the Republic of the Philippines, by virtue of the powers vested in me by law, do hereby order:

Section 1. Segregation and Disposition of the Property as Housing and Relocation Sites. – The subject 1,551.1416-hectare property is hereby declared as housing and relocation sites for government employees and informal settler-families living in danger areas, respectively, to be subdivided and disposed in the following manner: (a) 300 hectares for the Armed Forces of the Philippines [AFP]; (b) 300 hectares for the Philippine National Police [PNP]; (c) 300 hectares for teachers; (d) 300 hectares for other government employees; and (e) the remaining 351.1416 hectares for the informal settler-families living in danger areas whose homes were destroyed by Typhoon Ondoy, and those who may be similarly situated caused by future catastrophes.

Section 2. Transfer, development and administration of property. – Within thirty (30) days from the effectivity of this Order, the BSP and DOF shall execute the necessary instruments to ensure the transfer of ownership of the 1,551.1416-hectare property to the NHA.

Section 3. Funding allocation. The NHA, as administrator of the housing site, together with the Department of Budget and Management, shall secure the allocation of a budget to implement this Executive Order, taking into account the funding requirement for various activities to be undertaken in connection hereof, such as, but not limited to, the establishment of a fund sourcing scheme to finance the project.

The AFP, PNP and the Department of Education (DepEd) shall provide corresponding funds from their respective savings for site development cost and other logistical requirements for this project.ℒαwρhi৷

Section 4. Implementing Rules and Regulations. – An Executive Committee composed of the General Manager of NHA as Chairperson and representatives from the Department of Social Welfare and Development, HUDCC, AFP, PNP and DepEd, as members, is hereby created to formulate the policies ( i.e., qualification of beneficiaries, lot pricing or payment scheme, etc.) for the effective implementation of this Executive Order.

Section 5. Separability. – Any portion or provision of this Executive Order that maybe declared unconstitutional shall not have the effect of nullifying its other portions or provisions, as long as such remaining portions can still be given effect.

Section 6. Repealing Clause. – All executive orders, rules and regulations and other parts thereof which are inconsistent with this Order are hereby revoked, amended or modified accordingly.

Section 7. Effectivity. – This Order shall take effect immediately.
