[ EXECUTIVE ORDER NO. 472, August 01, 1991 ]

SUSPENDING THE APPLICATION OF THE TARIFF CONCESSIONS GRANTED BY THE PHILIPPINES ON REFRACTORY BRICKS UNDER THE ASEAN PREFERENTIAL TRADING ARRANGEMENTS

WHEREAS, the Philippines presently grants a 10% binding concession and a 25% Margin of Preference (MOP) on refractory bricks under the ASEAN Preferential Trading Arrangement;

WHEREAS, such grant of tariff concessions has resulted in the surge of imports of subject articles thereby causing serious injury to the concerned local industries;

WHEREAS, the Agreement on the ASEAN Preferential provides for the adoption by any importing Contracting State of emergency measures if, as a result of the implementation of the Agreement, imports of products enjoying tariff preferences are increasing in such a manner as to cause or threaten to cause serious injury to sectors producing like or similar products in the said importing Contracting State;

NOW, THEREFORE, I, CORAZON C. AQUINO, President of the Philippines, pursuant to the powers vested in me under Section 402 of the Tariff and Customs Code of 1978, as amended, do hereby order:

Section 1. The application of the tariff concessions granted by Philippines on the products listed in the attached Annex "A" under the ASEAN Preferential Trading Arrangements is hereby suspended.

Section 2. Upon the effectivity of this Executive Order, imports of subject articles from the ASEAN countries shall be levied the existing rates of duty indicated in Column 3 of the said Annex "A".

Section 3. In the event that any subsequent changes are made in the basic Philippine rate of duty on any of the subject articles, such articles shall automatically be accorded the corresponding amended rate of duty.

Section 4. This Executive Order shall take effect fifteen (15) days after publication in two (2) newspapers of general circulation.
