PRESCRIBING THE POLICY TO BE OBSERVED IN THE PROMOTION OF RETIRED OFFICERS OF THE PHILIPPINE ARMY RECALLED TO ACTIVE DUTY

Pursuant to the authority vested in me by section twenty-two of Commonwealth Act Numbered One, known as the National Defense Act, I, MANUEL L. QUEZON, President of the Philippines, do hereby prescribe the following policy to be observed in the promotion of retired officers of the Regular Force in the Army of the Philippines, who have been, or might hereafter be, recalled to active duty:

Any retired officer recalled to active duty shall be thereafter eligible for promotion in the retired list, while he continues on such active duty, provided he is declared eligible for promotion by the Efficiency Board as specified in Executive Order Numbered One hundred sixty-nine, dated October fifteenth, nineteen hundred and thirty-eight, entitled “Regulation governing seniority, promotion, and elimination of officers of the Regular Force, Philippine Army:” Provided, That such promotion shall be governed by seniority in the corresponding grade or rank, seniority to be determined by the length of active service rendered in each grade: And provided, further, That such promotion shall be made coincident with the promotion of the first regular officer of less service in grade who may be promoted.
